Terms of Service
1. Purpose and Acceptance
These Terms of Service ("Terms") govern access to and use of the Ascelyo mobile application and online service ("the Service"), published by Mansour Habibou Hamani (Ascelyo Software), a sole proprietor (Entrepreneur Individuel) trading as "Ascelyo Software", registered under SIRET 10438683400014 (APE code 5829C — software publishing), with its registered office at 2 boulevard Georges Méliès, 94360 Bry-sur-Marne, France ("Ascelyo").
By creating an account or using the Service, you agree to these Terms without reservation. If you do not accept them, you may not use the Service.
These Terms form a legally binding contract between you and Ascelyo, and supplement our Privacy Policy and Cookie Policy.
2. Account Creation
2.1 Eligibility
- You must be at least 16 years old to create an account and use the Service
- You must provide a valid email address and a secure password
- You agree to provide accurate, complete information and keep it up to date
- Only one account per natural person is permitted
2.2 Account security
You are solely responsible for keeping your login credentials confidential. You agree to notify us immediately of any unauthorised access to your account at contact@ascelyo.app. Ascelyo shall not be liable for losses resulting from unauthorised use of your account.
2.3 Application download
The application is available as a free download via Apple's App Store. When you download the application, you are also subject to Apple's applicable terms and conditions. Premium subscriptions are available exclusively as in-app purchases through the Apple App Store, managed via your Apple account.
3. Subscription and Payment
3.1 Available plans
Ascelyo offers the following plans:
- Free: access to core features, no commitment, no credit card required
- Premium: full access to AI assistance, voice journal, weekly reviews, advanced analytics and unlimited features — available monthly or annually
Current pricing is displayed on the App Store at the point of purchase.
3.2 Automatic renewal
The Premium subscription renews automatically at the end of each billing period (monthly or annual) unless cancelled at least 24 hours before the end of the current period, per App Store rules. The amount for the next period will be charged to the payment method registered on your Apple account.
3.3 Payment terms
Payments are managed exclusively via Apple App Store in-app purchases and processed by RevenueCat, Inc. (subscription management). No direct payment is made to Ascelyo: subscription, management and cancellation are all performed from Settings > Subscriptions on your iPhone.
3.4 Anti-abuse clause (free trial)
The free trial is reserved for new users who have never held a paid subscription. Ascelyo maintains a deletion log to detect and prevent fraudulent account resets to obtain multiple free trials. In the event of detected abuse, trial access may be refused and the account suspended.
4. Free Trial
A 30-day free trial may be offered to new subscribers signing up for the first time. This offer is valid once per person and per email address. No credit card is required to start the trial, according to the terms displayed in the application.
At the end of the trial period, the subscription automatically converts to a paid subscription at current prices, unless cancelled before the trial ends.
5. Refunds and Right of Withdrawal
5.1 Statutory right of withdrawal (EU consumers)
Under EU Directive 2011/83/EU on consumer rights, you have a 14-day right of withdrawal from the date you subscribe to a paid plan, without giving any reason.
However, by immediately starting to use the premium features after subscribing, you expressly acknowledge that service delivery has begun before the end of the withdrawal period and agree to waive this right for the portion of the service already provided, in accordance with applicable consumer law.
5.2 Refund policy
Refund requests not covered by the statutory withdrawal right are considered case by case. Contact us at contact@ascelyo.app within 14 days of payment. Approved refunds are issued by Apple to the original payment method within 5 to 10 business days, per App Store refund policy.
5.3 How to exercise your withdrawal right
To exercise this right, send a clear statement to contact@ascelyo.app indicating your decision to withdraw (name, account email, subscription date). We will process your request within 14 days.
6. User Obligations
By using the Service, you agree not to:
- Post, transmit or store illegal, defamatory, obscene, threatening content or content infringing third-party rights
- Impersonate another person or entity
- Scrape, extract or automatically copy data from the Service without written authorisation
- Attempt to circumvent security mechanisms, reverse-engineer or decompile the application
- Deliberately attempt to circumvent, manipulate or "jailbreak" the AI models integrated in the Service
- Use the Service for commercial purposes without prior written authorisation from Ascelyo
- Share your account with others or resell access to the Service
- Send unsolicited communications (spam) via Service features
- Infringe the intellectual property rights of Ascelyo or third parties
Any breach of these obligations may result in immediate suspension or termination of your account without refund, and without prejudice to any liability claims.
7. AI Disclaimers
Ascelyo's AI assistance service is not a substitute for professional medical, financial, legal or psychological advice.
- AI-generated recommendations are for informational and personal development purposes only. They do not constitute a medical diagnosis, investment advice or legal opinion
- You remain solely responsible for your life, professional, financial and health decisions
- If you are experiencing psychological distress, please consult a qualified mental health professional
- AI responses may contain errors or inaccuracies. They should not be used as the sole basis for decision-making
- Ascelyo accepts no liability for the consequences of decisions made based on AI recommendations
8. Intellectual Property
8.1 Your content
You retain full ownership of your content (goals, journal entries, voice recordings, notes). By using the Service, you grant us a limited, non-exclusive, worldwide, revocable licence strictly necessary to provide the Service and generate your personalised recommendations. This licence terminates upon deletion of your account.
We do not use your content for any other purpose, including training AI models or building commercial databases.
8.2 Our intellectual property
The Ascelyo application, its source code, design, trademarks, logos, AI prompts, assistance algorithms and all associated documentation are the exclusive property of Ascelyo or its licensors. Any unauthorised reproduction, modification or distribution is strictly prohibited.
9. Service Availability
Ascelyo endeavours to maintain the Service available 24/7. However, we reserve the right to temporarily suspend the Service for maintenance, updates or force majeure. We shall not be liable for resulting interruptions.
In the event of a significant planned interruption, we will endeavour to notify you by email or in-app notification as early as possible.
10. Termination
10.1 By you
You may cancel your subscription at any time via the application settings or by contacting us. Cancellation takes effect at the end of the current billing period. To permanently delete your account and all your data, use Settings → Data & Privacy → Delete my account.
10.2 By Ascelyo
Ascelyo may terminate or suspend your access to the Service in the following cases:
- For cause (immediate effect): breach of these Terms (notably Section 6), fraud, impersonation, attempt to manipulate AI systems
- For other reasons (30 days' notice): discontinuation of the Service, change in business model
In the event of termination for cause, no refund will be granted. In the event of termination by Ascelyo for other reasons with 30 days' notice, the pro-rata portion of the unused period will be refunded.
11. Limitation of Liability
To the extent permitted by applicable law, Ascelyo's total liability to you — for any cause whatsoever — is capped at 12 months of subscription fees actually paid in the 12 months preceding the claim, or €50 if you use the free plan.
Ascelyo shall not be liable for indirect, consequential, incidental or punitive damages, including data loss (except where caused by our gross negligence), loss of revenue, or decisions made based on AI recommendations.
These limitations do not apply in cases of fraud, gross negligence, death or personal injury caused by our negligence, or to any extent prohibited by applicable law.
12. Governing Law and Disputes
These Terms are governed by French law, without regard to conflict of laws rules.
12.1 Amicable resolution
In the event of a dispute, we invite you to contact us first at contact@ascelyo.app for an amicable resolution. We commit to responding within 30 days.
12.2 Mediation (EU consumers)
If amicable resolution fails, you may refer the matter to a consumer mediator pursuant to Directive 2013/11/EU. European Commission online dispute resolution platform: ec.europa.eu/consumers/odr.
12.3 Jurisdiction
Failing amicable resolution, any dispute shall be subject to the exclusive jurisdiction of the courts of Créteil (Val-de-Marne), France, subject to mandatory consumer law provisions applicable in your country of residence.
13. Changes to These Terms
Ascelyo reserves the right to amend these Terms at any time. For material changes, you will be notified by email or in-app notification at least 30 days before the new version takes effect.
Continued use of the Service after the effective date constitutes acceptance of the amended Terms. If you do not accept the changes, you may cancel your subscription before the effective date without additional charges.
